1. Introduction

Welcome to the Search Spares website (the “Website”). These Terms and Conditions of Use (“Terms of Use”) govern your use of the Website and form a legally binding agreement between the User of this Website (“you”, “your”, “yours”) and Search Spares (“we”, “us”, “our”).

By accessing or using the Website, you confirm that you have read, understood and agree to be bound by these Terms of Use. If you do not agree, you must not use the Website.

• 5.2: You are solely responsible for making all arrangements necessary for access to the Website and for ensuring that any person accessing the Website through your internet connection is aware of and complies with these Terms.

6. User Accounts

• 6.1: Registration is required in order to place advertisements. Registration shall be completed by providing a valid email address and creating a secure password.
• 6.2: You are responsible for maintaining the confidentiality of your login details and for all activities carried out under your account. Search Spares accepts no liability for any loss or damage arising from your failure to protect your account credentials.
• 6.3: Accounts are personal to the registrant and are not transferable. You must not permit any other person to use your account.
• 6.4: Search Spares reserves the right to suspend or terminate accounts that are inactive, in breach of these Terms or otherwise deemed detrimental to the operation of the Website.
• 6.5: You may request deletion of your account at any time. Deletion will be carried out in accordance with our Privacy Policy and applicable data protection laws.

Such communications may include, without limitation, notifications regarding your account, advertisements you have placed, or changes to these Terms.

• 8.1: The services made available on the Website from time to time include, without limitation the creation, submission, publication and management of advertisements for motorcycle parts and accessories (and, in due course, motor vehicle parts and accessories); the uploading of photographs and descriptions in connection with such advertisements; the ability to search and view advertisements posted by other users; and the ability to communicate with advertisers and other users through the functions provided for that purpose.
• 8.2: We operate the Website solely as a classified advertisements platform. We do not supply, purchase or sell goods ourselves, and we are not a party to any transaction between users. Advertisers remain entirely responsible for the accuracy, legality and authenticity of their advertisements. While we may carry out limited checks of advertisements, such checks do not constitute an assumption of responsibility or liability on our part.

9. Advertising Rules

• 9.1.1: When creating an advertisement on the Website you must ensure that all information provided is accurate, current and complete, and you must promptly update any information which becomes inaccurate, incomplete or misleading.
• 9.1.2: Advertisements must relate solely to motorcycle parts and accessories, and where applicable motor vehicle parts and accessories. Each advertisement must concern a single item or a set of directly linked items. Multiple unrelated items may not be grouped within a single listing.
• 9.1.3: Advertisements must not contain material which is illegal, defamatory, obscene, indecent, offensive or otherwise objectionable in accordance with Section 10 below. Advertisements must not be duplicated, miscategorised, or otherwise manipulated in order to gain undue prominence. The use of multiple brand names, keywords or search terms within an advertisement in a way that causes it to appear in the wrong category or in irrelevant search results is strictly prohibited.
• 9.1.4: We do not exercise editorial control over the content of advertisements placed by users and we do not guarantee the accuracy, integrity or quality of such content. By using the Website, you acknowledge that you may encounter content that is inaccurate, misleading, offensive, indecent or objectionable, and you agree that we shall have no liability in respect of such content.
• 9.1.5: We reserve the right, at our sole discretion, to decline, suspend or remove any advertisement which breaches these Terms, which is inaccurate or misleading, or which we consider unsuitable for publication for any reason, in accordance with Section 12 below.

10. Restrictions on Use

• 10.1: You must not use the Website in any manner which is unlawful, fraudulent or in breach of these Terms.

You acknowledge that we are not responsible for, and shall have no liability in respect of, any disputes, losses, damages or claims arising from dealings between users. As a result, you may encounter content or conduct that you consider offensive, misleading or objectionable. You may report such content to us by contacting us here , but we do not guarantee the removal of any material and we shall have no liability in respect of content posted by users.
• 11.3: Your interactions with other users, including all arrangements for payment and delivery of goods, and any representations, terms, warranties or conditions associated with such dealings, are solely between you and the relevant user. We accept no responsibility for, and give no warranties in respect of, any such transactions. Although we reserve the right to monitor or intervene in disputes between users, we are under no obligation to do so.

• 13.1: Advertisements shall remain live for such period as determined by us from time to time, after which they may be automatically removed.

14. Fair Usage Policy

• 14.1: We operate a fair usage policy. Users must not create multiple listings for the same item, post excessive or repetitive content, or otherwise act in a manner which places an unreasonable burden on the Website. Non-compliance may result in removal of advertisements and suspension of accounts.

15. Intellectual Property

• 15.1: All intellectual property rights in the Website, including but not limited to its design, layout, text, graphics, logos and software, are owned by or licensed to us.
